Professional Negligence

We advise on and bringing claims of negligence against professionals, for instance solicitors or barristers, architects, surveyors and accountants. Where a professional has acted for you or advised you but has failed in his or her duty of care by providing negligent or wrong advice, inaction and delay, and as a result you have suffered significant financial loss, you may have a case of professional negligence against that professional.

You may not recognise that a professional adviser has done wrong so it is important you seek prompt independent advice from expert lawyers. We will seek to ascertain whether the professional has breached his or her duty of care to you. We can advise you on your rights and remedies including the amount you can claim.

Most professionals will have professional indemnity insurance so a successful claim will most likely be paid by the insurer. We provide prompt and realistic advice and will guide you through the process and represent you in your claim. If we believe you have a good case, we may be prepared to act for you on a "no win, no fee" basis.

In order to claim against a professional you must show:

1. That the professional owed you a duty of care

This is usually not difficult if you have engaged the professional to provide a service for you, because you will probably have a contract with the professional. All providers of a service under contract have a duty to provide the service with due skill and diligence – and where the time isn’t specified – within a reasonable time.

2. That the professional has breached that duty of care

You have to prove that the standard of work provided by the professional is worse than that you should expect from a reasonable professional working in the circumstances of your case.

3. The breach of duty of care has caused you loss

This is often the hardest part to prove. You have to prove that you are worse off than you would have been had the professional provided the service with due skill and diligence. Sometimes, especially with negligent advisers, their negligence has not caused actual loss, so much as disappointment, in that you are simply worse off than you thought you were. Such disappointment does not on its own give you a claim.
